4. EU Email Sending — GDPR & ePrivacy Compliance
Where we send electronic communications to individuals located in the European Economic Area (EEA), we operate in accordance with:
- Regulation (EU) 2016/679 (GDPR) — General Data Protection Regulation.
- Directive 2002/58/EC (ePrivacy Directive) — also known as the "Cookie Directive" or "Spam Directive".
Specifically, we:
- Obtain freely given, specific, informed, and unambiguous consent before sending marketing emails to EU residents.
- Record and store proof of consent with timestamps and source.
- Provide EU residents with the right to withdraw consent at any time without detriment via every email footer or by contacting us directly.
- Do not rely on pre-ticked boxes or inferred consent as a lawful basis for marketing emails.
- Maintain a suppression list of email addresses that have opted out to prevent future contact.
- Where applicable, appoint a Data Protection Officer (DPO) and maintain records of processing activities.
Our legal basis for sending transactional emails to EU members is performance of a contract (Article 6(1)(b) GDPR). Our legal basis for marketing emails is consent (Article 6(1)(a) GDPR).
